General terms and conditions catz-n-dogz
1. Scope of validity, customer information
The following General Terms and Conditions (GTC) govern the contractual relationship between catz-n-dogz and consumers who purchase goods in our shop. The contract language is German.
2. Conclusion of contract
(1) The offers on the Internet represent a non-binding invitation to you to purchase goods.
(2) You can put one or more products into the cart. In the course of the order process you enter your data and desires concerning payment method, delivery modalities etc. Once you have clicked the order button, you submit a binding offer to conclude a purchase contract.
(3) With the immediate submission of confirmation of receipt by e-mail the offer will also simultaneously be deemed accepted and the sales contract concluded.
(4) Content Assessment of Individual Design: the transfer of necessary information, text or data to design some products indivdually will be provided by the customer while ordering or right after the order process via e-mail. Please note that you agree not to transmit any data, where the contents infringe rights of third parties (in particular copyrights, naming rights, trademark rights) or violate existing laws. The Customer is the legal owner or officially licenced partner of the submitted designs and elements for individual design requests. If this not be the case, the Customer has obtained prior approval by the legal owner.
The design submitted by the Customer or any single elements required for the implementation of the individual design will be adopted without being checked by catz-n-dogz and we do not bear any liability in that case.
3. Customer information: Storage of the contractual text
Your order with details of the contract concluded (e.g. type of product, price, etc.) will be stored by us. We will send the GTC to you, but you can also access the GTC at any time via our website. As registered customer you can access your passed orders over via the customer login area: My account.
4. Customer information: Correction Note
You can amend your entries at any time before submitting the order by using the delete key. We will keep you informed throughout the checkout process of further correction options. You can terminate the order process also at any time by closing of the browser window completely.
5. The warranty
The warranty complies with the statutory provisions.
6. Prices and payment terms
Our prices are end consumer prices in Euro including actual valid German taxes, not including transport or packaging costs. Subject to technical alterations, errors and misprints excepted.
We deliver against payment in advance. For payment in advance it is necessary that we receive the full amount of invoice within 10 days from order confirmation on following bank account:

7. Delivery
At the moment we only ship to the from us announced countries and to named shipping costs. We will delivery after receipt of full invoice amount. If there are products not available within 4 weeks after order confirmation you will be informed as soon as we got knowledge of this. In case we cannot deliver, we will refund your payment.
We always care to send all ordered products in one single shipment. So the delivery time is directly related to the product with the longest delivery time. If there will not be all goods available in once, catz-n-dogz is allowed to make partial shipments on their own account, as long as it is reasonable for the customer.
8. Shipping costs
shipping costs 4,90 € (incl. taxes) up to 31,5 kg within Germany. From 39 € order amount no shipping costs within Germany only.
At the moment we only ship within Germany.
9. Cancellation
If we will not receive full invoice amount on our bank account within 10 days after order confirmation we have the right to cancel the order within 14 days after knowledge. If it is not possible to reach you at your named address up to 3 times or if you refuse acceptance of our shipment catz-n-dogz has the right to withdraw the contract and cancel the order. All transport expenses are on your account then.
10. Instructions on withdrawal
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last goods.
To exercise the right of withdrawal, you must inform us (catz-n-dogz, Eichenäcker 4, 92318 Neumarkt i.d.OPf., Germany, Tel. +49 5251 2977949, Fax +49 3212 1062801, info@catz-n-dogz.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the following model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise, in any event, you will not incur any fees as a result of such reimbursement. You shall send back the goods or hand them over to us or INT-GmbH, Heisenbergstr. 7, 33104 Paderborn, Germany, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion
The right of cancellation does not exist for distance-selling contracts for the delivery of goods to be manufactured according to customer specifications or clearly tailored to personal needs.
Kein Widerrufsrecht für Unternehmer
Wenn Sie Unternehmer im Sinne des § 14 Bürgerlichen Gesetzbuches (BGB) sind und bei Abschluss des Vertrags in Ausübung Ihrer gewerblichen oder selbständigen beruflichen Tätigkeit handeln, besteht das Widerrufsrecht nicht.

Please let us know your back shipment in advance by email. Then you can count on our fastest handling of your request.
11. Packaging Ordinance
Regarding the transport packaging used and filled by us to be sent to end consumers catz-n-dogz joins recycling obligations of Landbell AG Mainz (§ 6 VerpackV).
12. Damages in transit
If you receive parcels with obvious damages, please claim this immediately to the transport company otherwise the entitlement to damages as well as insurance benefits expire. This has no influence on your general rights of warranty.
13. Miscellaneous
This contract is under full German Rights. United Nations Convention on Contracts for the International Sale of Goods is of no use.
Ausschließlicher Gerichtsstand ist das Amtsgericht unseres Geschäftssitzes soweit der Kunde ein Kaufmann in Sinne des HGB oder eine Körperschaft des öffentlichen Rechts ist.

14. Informationspflicht gemäß Batteriegesetz (BattG)
Im Zusammenhang mit dem Vertrieb von Batterien oder Akkumulatoren oder mit der Lieferung von Geräten, die Batterien oder Akkumulatoren enthalten, sind wir gemäß der Batterieverordnung verpflichtet, auf Folgendes hinzuweisen: Batterien dürfen nicht in den Hausmüll gegeben werden. Sie sind zur Rückgabe gebrauchter Batterien als Endverbraucher gesetzlich verpflichtet. Sie können Batterien nach Gebrauch in der Verkaufsstelle oder in deren unmittelbarer Nähe (z.B. in kommunalen Sammelstellen oder im Handel) unentgeltlich zurückgeben. Sie können Batterien aus unserem Sortiment in üblicher Menge auch per Post an uns zurücksenden. Batterien oder Akkumulatoren, die Schadstoffe enthalten, sind mit dem Symbol einer durchgekreuzten Mülltonne gekennzeichnet. In der Nähe zum Mülltonnensymbol befindet sich die chemische Bezeichnung des Schadstoffes. "Cd" steht für Cadmium, "Pb" für Blei, "Hg" für Quecksilber, "Li" für Lithium, "Ni" für Nickel, "Mh" für Metallhydrid und "Zi" für Zink.

Gesetz über das Inverkehrbringen, die Rücknahme und die umweltverträgliche Entsorgung von Elektro- und Elektronikgeräten
Hersteller müssen seit dem 13. August 2005 in den Verkehr gebrachte, alte Elektrogeräte kostenlos zurücknehmen. Die Hersteller müssen ihre Elektro- und Elektronikgeräte, die nach dem 23. November 2005 in Verkehr gebracht werden, mit einem Symbol (durchgestrichene Abfalltonne auf Rädern) kennzeichnen.
Als Händler sind wir gesetzlich verpflichtet, Sie hiermit zu informieren, dass solche Altgeräte nicht als unsortierter Siedlungsabfall zu beseitigen sind, sondern getrennt zu sammeln und über die örtlichen Sammel- und Rückgabesysteme zu entsorgen sind.
Gemäß dem Gesetz "ElektroG" vom 23.März 2005 verkaufen wir ab dem 25. November 2005 nur noch Elektro- und Elektronikgeräte von Herstellern, welche sich entsprechend bei der zuständigen Behörde registriert haben und eine insolvenzsichere Garantie für die Finanzierung der Rücknahme und Entsorgung ihrer Elektrogeräte nachweisen können.
15. severability clause
If any term of this Agreement is to any extent invalid, illegal, or incapable of being enforced, such term shall be excluded to the extent of such invalidity, illegality, or unenforceability; all other terms hereof shall remain in full force and effect.
